Goza | Honnold handling Fleet Phosho-Soda/Kidney Damage cases

Our firm is currently representing people who have suffered acute or chronic kidney injury after taking Fleet Phospho Soda. C.B. Fleet, which manufactures Fleet Phospho Soda, is facing a number of these lawsuits around the country. This product was available over the counter (OTC). It was taken by thousands until C.B. Fleet announced a voluntary recall of its OTCs products in December of 2008. Fleet Phospo Soda is an Oral Sodium Phosphate (OSP). OSPs have been used as laxatives by people suffering from constipation. They have also been used extensively at higher doses for bowel cleansing in preparation for a colonoscopy or certain x-ray procedures.

Recent medical articles have reported a number of cases in which patients developed a kidney damage known as acute phosphate nephropathy following Fleet Phospho Soda use at higher doses as a bowel cleanser. Older patients, those with prior kidney or heart disease, or acute colitis and those patients on certain medications such angiotensin converting enzyme (ACE) inhibitors, angiotensin receptor blockers (ARB), and some non-steroidal anti-inflammatory drugs (NSAIDs), seem to be at greater risk. Acute phosphate neuropathy can result in dialysis or the need for kidney transplant. The lawsuits assert that C.B. Fleet marketed and sold their OSP products without adequately warning of these risks.

On December 11, 2008, the FDA released a new Alert, announcing a black box warning (the strongest FDA warning) would be added to prescription OSPs bowel cleansers such as Visicol and OsmoPrep. The FDA also indicated that OTC laxatives such as Fleet Phospho Soda should not be used in high doses for bowel preparation and should only be available by prescription. In response, on December 15, 2008, C.B. Fleet announced a voluntary recall of its OTC products..
